Constitutional, Statutory, Regulatory and Procedural Authorities

Federal registration of trademarks is based on the Commerce Clause of the United States Constitution, Article 1, Section 8, clause 3: "The Congress shall have Power ... To regulate Commerce ... among the several States, ...  ."  The federal statutes governing trademark registration, known as the "Lanham Act," are codified in Title 15, chapter 22

The United States Patent and Trademark Office (USPTO) is an agency under the United States Department of Commerce in charge of registering federal trademarks. The federal regulations related to trademarks are found in Title 37, chapter 2 of the Code of Federal Regulations.  The USPTO's Trademark Manual of Examining Procedure, the latest edition available on the USPTO's website, is used by trademark examiners for reviewing trademark applications.

Trademarks also may be regulated by state law.  The South Dakota Trademark and Service Mark Protection statutes are found at South Dakota Codified Laws ch. 37-6

The South Dakota Secretary of State's office is the filing agent for trademark, emblem and Farm/Ranch/Home Name registration under state law.

 

Administrative Decisions and Case Law

The appeal of a rejection of an Application for registration, an Opposition to a pending trademark application, or a Cancellation to an active trademark is filed with the USPTO's Trademark Trial and Appeal Board (TTAB). The Trademark Trial and Appeal Board Manual of Procedure (TBMP) is available from the USPTO website.  TTAB decisons are available at:

Decisions of the TTAB may be appealed directly to the U.S. Court of Appeals for the Federal Circuit, or a civil suit against the PTO brought in federal district court, with an appeal to the regional appellate court.

Actions to enforce federal trademark rights under the Lanham Act are brought in federal district court, with appeal to the appropriate regional circuit court, not the U.S. Court of Appeals for the Federal Circuit.
